Fernmeldeüberwachung: Technisches Konzept zur Datenübermittlung

Der Dienst Überwachung Post- und Fernmeldeverkehr (Dienst ÜPF) hat am
28.03.2012 ein Dokument mit technischen Angaben veröffentlicht, die
sicherstellen, dass die Fernmeldedienstanbieterinnen (FDA) ihre Daten dem
Dienst ÜPF übermitteln können. Der Dienst ÜPF fordert bei den FDA
solche Daten im Auftrag von Strafverfolgungsbehörden zur Aufklärung
schwerer Straftaten an.

Sehr geehrte Damen und Herren

Das so genannte Ausleitungskonzept, das am 28.03.2012 veröffentlicht
wurde, ergänzt die revidierte Verordnung über die Überwachung des Post-
und Fernmeldeverkehrs (VÜPF) und die technischen Richtlinien für die
Telekommunikationsüberwachung TR TS (Version 3.0). Der Dienst ÜPF hat das
Konzept in intensiver Zusammenarbeit mit den FDA erarbeitet. Es beschreibt
die allgemein gültigen Rahmenbedingungen und neue mögliche
Ausleitungsnetze in IP-Technologie. Gestützt auf das Ausleitungskonzept
schliesst der Dienst ÜPF mit jeder einzelnen FDA Anbindungsvereinbarungen
ab. Diese regeln alle technischen Einzelheiten, wie z.B. physikalische
Übergabepunkte, Netzadressen, Zuständigkeiten oder Kontaktstellen.

Das Ausleitungskonzept richtet sich ausschliesslich an FDA, die dem
Bundesgesetz betreffend die Überwachung des Post- und Fernmeldeverkehrs
(BÜPF) unterstellt sind. Das BÜPF verpflichtet die FDA, dem Dienst ÜPF
Daten aus Überwachungsmassnahmen zuzuleiten, die von Staatsanwaltschaften
zur Aufklärung schwerer Straftaten angeordnet und vom zuständigen
Zwangsmassnahmengericht genehmigt wurden.

Zum Verfahren der Post- und Fernmeldeüberwachung
Zur Aufklärung schwerer Straftaten können die Schweizer
Strafverfolgungsbehörden, gestützt auf die Schweizerische
Strafprozessordnung (StPO; SR 312.0) Massnahmen zur Überwachung des Post-
und Fernmeldeverkehrs anordnen. Jede Überwachungsanordnung einer
Staatsanwaltschaft muss von der zuständigen richterlichen
Genehmigungsbehörde (Zwangsmassnahmengericht) der Kantone oder des Bundes
geprüft und genehmigt werden. Der Dienst ÜPF nimmt zuletzt eine formelle
Prüfung vor. Dabei prüft er, ob die anordnende Behörde tatsächlich
zuständig ist und ob sich die Überwachungsanordnung auf eine strafbare
Handlung gemäss Deliktkatalog (Art. 269 StPO) bezieht. Der Dienst ÜPF
weist die Fernmeldedienstanbieterinnen anschliessend an, die fraglichen
Daten dem Dienst ÜPF zu übermitteln. Er stellt die Daten dann den
auswertenden Strafverfolgungsbehörden zur Verfügung. Vom Inhalt der Daten
und der betreffenden Ermittlungen erhält der Dienst ÜPF keine Kenntnis.

Die Pflichten der Fernmeldedienstanbieterinnen
Wer eine Fernmeldedienstleistung erbringt, muss dies dem Bundesamt für
Kommunikation (BAKOM) melden. Auf der Website des Dienstes ÜPF finden Sie
den Link zu den entsprechenden Meldeformularen.
Jede FDA ist verpflichtet, Überwachungsaufträge gemäss den Richtlinien
und Verfügungen des Dienstes ÜPF auszuführen. Um Überwachungen
vornehmen zu können, muss jede FDA eine geeignete Anlage bereithalten.
Alle FDA müssen jederzeit in der Lage sein, Überwachungsmassnahmen
durchzuführen. Um die Überwachungsbereitschaft der FDA sicherzustellen,
führt der Dienst ÜPF bei diesen ein Compliance-Verfahren durch. Die FDA
sind gemäss VÜPF verpflichtet, dem Dienst ÜPF die Namen ihrer
Kontaktpersonen (Lawful Interception Officer bzw. LI Officer) zu nennen
(Art. 18 Abs. 3 und 26 Abs. 3 VÜPF). Alle noch nicht beim Dienst ÜPF
registrierten FDA sind verpflichtet, sich unverzüglich zu melden.

Surveillance des télécommunications : prescriptions techniques pour la
transmission des données

Le Service de surveillance de la correspondance par poste et
télécommunication (Service SCPT) a publié, le 28 mars 2012, un document
avec des prescriptions techniques pour garantir que les fournisseurs de
services de télécommunication puissent lui transmettre les renseignements
demandés. Sur mandat des autorités de poursuite pénale, le Service SCPT
demande en effet aux fournisseurs de services de télécommunication de lui
transmettre des données en vue d’élucider des infractions pénales
graves.

Mesdames, Messieurs,

Le schéma directeur réglant les modalités de la transmission de données
publié ce mercredi complète l’ordonnance révisée sur la surveillance
de la correspondance par poste et télécommunication (OSCPT) et les
directives techniques relatives à la surveillance des télécommunications
(Technical Requirements for Telecommunication Surveillance, TR TS, version
3.0). Fruit d’une collaboration intense avec les fournisseurs de services
de télécommunication, ce document définit les conditions cadres
généralement applicables et décrit de nouveaux réseaux de transmission
potentiels, fondés sur la technologie internet. C’est aussi sur la base
de ce schéma directeur que le Service SCPT conclut une convention de
raccordement avec chaque fournisseur de services de télécommunication
afin de régler tous les détails techniques, comme le point de
transmission physique, les adresses réseau, les attributions respectives
et les services et interlocuteurs compétents.

Ce schéma directeur s’adresse exclusivement aux fournisseurs de services
de télécommunication, lesquels sont tenus, conformément aux dispositions
de la loi fédérale sur la surveillance de la correspondance par poste et
télécommunication (LSCPT), de livrer au Service SCPT les données
recueillies en exécution de mesures de surveillance ordonnées par les
ministères publics pour élucider des crimes graves et autorisées par le
tribunal des mesures de contrainte compétent.

Déroulement de la surveillance
Le code de procédure pénale suisse (CPP ; RS 312.0) permet aux autorités
de poursuite pénale d’ordonner des mesures de surveillance de la
correspondance par poste et télécommunication en vue d’élucider des
infractions graves. Tout ordre de surveillance édicté par un ministère
public doit être approuvé par l’instance judiciaire compétente
(tribunal des mesures de contrainte) au niveau cantonal ou fédéral. Avant
la mise en oeuvre proprement dite, le Service SCPT effectue encore un
dernier contrôle formel afin de s’assurer de la compétence de l’autorité
à l’origine de la mesure et de vérifier que la surveillance vise
effectivement la poursuite d’une infraction figurant dans la liste des
infractions pertinentes (cf. art. 269 CPP). Le Service SCPT ordonne alors
au fournisseur de services de télécommunication de lui faire parvenir les
informations demandées, avant de les transmettre à son tour aux
autorités de poursuite pénale chargées de les exploiter. Le service n’a
accès, à aucun moment, ni au contenu des données transmises, ni aux
détails des investigations.

Obligations des fournisseurs de services de télécommunication
Quiconque fournit un service de télécommunication doit l’annoncer à
l’Office fédéral de la communication (OFCOM). Toutes les informations
utiles et les formulaires établis à cet effet sont disponibles sur le
site internet du Service SCPT.
Les fournisseurs de services de télécommunication sont tenus d’exécuter
les mandats de surveillance selon les directives et les instructions du
Service SCPT. Ils doivent être en mesure de mettre en oeuvre, en tout
temps, des mesures de surveillance. Aussi chaque fournisseur doit-il
disposer, à cet effet, d’une infrastructure appropriée, prête à
fonctionner. Le service effectue des contrôles de conformité auprès des
fournisseurs afin de s’assurer qu’ils sont bien en mesure de procéder aux
surveillances ordonnées. Conformément aux dispositions de l’OSCPT (cf.
art. 18, al. 3, et art. 26, al. 3, OSCPT), les fournisseurs de services de
télécommunication ont l’obligation de communiquer au Service SCPT le nom
des collaborateurs compétents pour les questions en lien avec
l’interception légale des télécommunications (Lawful Interception
Officers ou LI Officers). S’ils ne l’ont pas encore fait, les fournisseurs
de services de télécommunication doivent s’annoncer sans délai au
service.

Sorveglianza delle telecomunicazioni: specifiche tecniche per la
trasmissione dei dati

Il 28 marzo 2012 il Servizio di sorveglianza della corrispondenza postale e
del traffico delle telecomunicazioni (Servizio SCPT) ha pubblicato un
documento contenente le specifiche tecniche che garantiscono la
trasmissione dei dati da parte dei fornitori di servizi di
telecomunicazione (fornitori). Il Servizio SCPT richiede tali dati su
incarico delle autorità inquirenti al fine di far luce su reati gravi.

Distinte signore, egregi signori,

Le specifiche di trasferimento pubblicate mercoledì vanno a integrare
l’ordinanza riveduta sulla sorveglianza della corrispondenza postale e
del traffico delle telecomunicazioni (OSCPT) e le direttive tecniche per la
sorveglianza delle telecomunicazioni TR TS (versione 3.0). Le specifiche,
messe a punto in stretta cooperazione con i fornitori, definiscono le
condizioni applicabili in termini generali e le nuove possibili reti di
trasferimento in tecnologia IP. Fondandosi su tali specifiche, il Servizio
SCPT firma, con ogni singolo fornitore, un accordo di allacciamento che
definisce tutti i particolari tecnici, quali i punti di consegna fisici,
gli indirizzi di rete, le competenze e le persone di riferimento.

Destinatari esclusivi delle specifiche di trasferimento sono i fornitori
soggetti alla legge federale sulla sorveglianza della corrispondenza
postale e del traffico delle telecomunicazioni (LSCPT), che impone loro di
trasmettere al Servizio SCPT i dati risultanti dalle misure di sorveglianza
disposte dai pubblici ministeri e confermati dal competente giudice dei
provvedimenti coercitivi per far luce su reati gravi.

Procedura di sorveglianza
In virtù del Codice di procedura penale (CPP; RS 312.0), le autorità
inquirenti svizzere possono disporre misure di sorveglianza della
corrispondenza postale e del traffico delle telecomunicazioni al fine di
far luce su reati gravi. Ogni ordine di sorveglianza spiccato da un
pubblico ministero va esaminato nel merito e approvato dalla competente
autorità giudiziaria cantonale o federale (giudice dei provvedimenti
coercitivi). Il Servizio SCPT procede infine a un esame formale
controllando se l’autorità disponente è effettivamente competente e se
la sorveglianza ordinata è connessa a un reato figurante nell’elenco
dell’articolo 269 CPP. Il Servizio SCPT ordina quindi ai fornitori di
trasmettergli i dati richiesti, consegnandoli a sua volta alle autorità
inquirenti incaricate di trattarli. Il Servizio SCPT non viene a conoscenza
né del contenuto dei dati trasmessi né dei dettagli investigativi.

Obblighi dei fornitori
Chi fornisce un servizio di telecomunicazione deve annunciarlo
all’Ufficio federale delle comunicazioni (UFCOM). Il link ai moduli di
notifica figura sul sito del Servizio SCPT.
Ogni fornitore è tenuto a compiere i mandati di sorveglianza seguendo le
direttive e le decisioni del Servizio SCPT. A tal fine deve dotarsi di
un’infrastruttura adeguata allo scopo ed essere pronto a procedere alla
sorveglianza in ogni momento. Il Servizio SCPT sottopone ogni fornitore a
controlli di conformità per assicurarsi che sia effettivamente in grado di
garantire la sorveglianza disposta. L’OSCPT (art. 18 cpv. 3 e 26 cpv. 3)
impone ai fornitori di comunicare al Servizio SCPT i nominativi delle
persone di riferimento (lawful interception officer o LI officer). Tutti i
fornitori non ancora registrati presso il Servizio SCPT sono tenuti a farlo
senza indugio.

Videokamera in der Herrentoilette

Mir ist aufgefallen, dass im Innenraum der öffentlich zugänglichen
Herrentoilette des Theaters zum Käfigturm in Bern eine Video-Kamera
installiert ist. Ist dies rechtens? – Und falls nicht, ist dies mit
einer Anzeige bei der Statdpolizei Bern zu lösen?

Sehr geehrter Herr A.

Wir beziehen uns auf Ihre unten stehende Anfrage betreffend eine Videoüberwachungsanalage im Theater Käfigturm Bern, welche uns zuständigkeitshalber weitergeleitet worden ist. Für Ihre Informationen und Ihr Interesse am Datenschutz danken wir Ihnen bestens und nehmen zu Ihrer Frage gerne wie folgt Stellung:

Grundsätzlich ist es erlaubt, im Privatbereich, z.B. zu Sicherheitszwecken, eine Videoüberwachungsanlage zu betreiben, sofern die datenschutzrechtlichen Bearbeitungsgrundsätze eingehalten werden. Was dies konkret bedeutet, kann in unserem Merkblatt „Videoüberwachung durch private Personen“ auf unserer Website nachgelesen werden. Zum vorliegenden Fall haben wir zudem folgende Bemerkungen:

Bei Videoüberwachungsanlagen auf Toiletten besteht die Gefahr, dass in die Intimsphäre der betroffenen Personen eingegriffen wird. Sollte beispielsweise in die Toilettenkabinen hinein gefilmt werden, wäre dies ein schwerwiegender Eingriff in die Persönlichkeitsrechte der betroffenen Personen, der sich kaum rechtfertigen lässt. Eine solche Videoüberwachung ist daher in der Regel widerrechtlich. Wird dagegen nur der Toilettenvorraum gefilmt, so greift dies weniger tief in die Persönlichkeitsrechte ein, und bei vorliegen eines berechtigten Sicherheitsinteressens am fraglichen Ort kann eine solche Massnahme gerechtfertigt sein.

Jede Videoüberwachungsanlage muss mittels gut sichtbarer Hinweisschilder für die Betroffenen kenntlich gemacht werden. Aus Ihren Ausführungen geht nicht klar hervor, ob dies beim Käfigturm berücksichtigt wurde. Ohne eine solche Kennzeichnung läge ein Verstoss gegen das Transparenzprinzip vor, was ebenfalls zu einer widerrechtlichen Verletzung der Persönlichkeit der Betroffenen führen kann.

Als von den Videokameras erfasste Person habe Sie das Recht, beim Betreiber der Anlage Auskunft über die Videoüberwachung zu verlangen. Der Gesetzgeber hat für den privatrechtlichen Bereich (d.h. Bearbeitungen von Personendaten durch Private) vorgesehen, dass die betroffene Person in erster Linie den zivilrechtlichen Weg beschreitet. Gelangen Sie aufgrund der mit dem Auskunftsgesuch erlangten Informationen zur Ansicht, durch die Videoüberwachung im Käfigturm widerrechtlich in Ihrer Persönlichkeit verletzt worden zu sein, können Sie beim für Ihren Wohnort zuständigen Zivilgericht oder beim Zivilgericht in Bern gestützt auf Art. 15 des Bundesgesetzes über den Datenschutz vom 19. Juni 1992 (DSG; SR 235.1) Zivilklage einreichen. Wurden Sie in Ihrer Intimsphäre verletzt, kommt auch eine Strafanzeige (Art. 179quater StGB) in Betracht. Wir empfehlen Ihnen jedoch, sich vor dem Einleiten rechtlicher Schritte anwaltlich beraten zu lassen. In den meisten Kantonen betreiben die Anwaltsverbände Rechtsberatungsstellen, bei denen Sie kostenlos oder gegen ein geringes Entgelt eine Erstberatung in Anspruch nehmen können. Personal concerns regarding SOPA, PIPA & ACTA

Tonight I am writing you in relation to my concerns on the recent activities around SOPA & PIPA.
The U.S. senate postponed PIPA, whereas SOPA goes back to the “drawing board”[0]. For the record: Neither the U.S. senate[1], nor the European Union[2] said “No” to the Acts, but only postponed the “decision”.

Let me introduce my concern with the following topic.
Today I received an invitation by the CCC[3] head quartier, calling for an extraordinary general meeting to discuss the expulsion of Daniel Domscheit-Berg (Daniel Domscheit-Berg aka “The Architect of Wikileaks” and founder of Openleaks[4]). You might have heard and remember, that Daniel, after not having been correctly informed by the board, decided to quit Wikileaks and found his proper project, which he, during the development process, intended to get reviewed and signed with some sort of “official seal” by the hackers of the CCC.
It might just have been an unfortunate move, as many protagonists were surprised by the reaction of the CCC and his enthousiasm.
So today the largest, and most powerful hacker society in Europe, calls for a meeting to discuss possible changes in the regulations of the Club, to legally allow expulsions of this sort. Actually I am very happy, that the CCC, with its “very german” way to sort out such “issues”, is calling for a discussion. But, – and as you might guess from my wording, – I am indeed very much worried.
After I met Julian & Daniel in person at the 25C3[5] and felt much respect towards their honorable efforts, this story has since taken the worst way, such a commitment can take. – Poor Bradley Manning…

Meanwhile (today as well) the best friend of my mother is calling me to ask, if I could tell her if it’s a good idea to buy an iPad, while Apple launches its EBook service with the following restrictions.

Well, yeah! – All this sort of crap is boring, I know. Information wants to be free[6]. And the Nyan Cats[7], “For the LULZ[8]” and whatever Laser Canon DDOS script by Anonymous are not bringing the matters further as well.
While most (h)activists are busy taking down websites of right wing parties or governments, they are, in the other hand, busy with some sort of “trench warfare” fighting GNU vs. BSD, CC vs. Public Domain etc. – Briefly, busy with themselves…

Last October, Richard was giving a talk[9] at the ETHZ (Swiss Federal Institute of Technology Zurich), explicitly explaining the 4 freedoms of Free Software. While the ETHZ, as the highest ranked academic institute in Switzerland, supplies the technical grey mass of the tomorrows technology companies, I was personally shocked how it comes, that Information Technology students in 2011 are still not aware of this fundamental knowledge.
In December, Cory held an epic talk in Zurich about the politics of copyright[10], while his presence was abused by one of the hosts (at least this was my personal impression), a person who is on the board of the federal cultural department of Switzerland, who has never ever published anything under GFDL or CC license, to promote herself and underlining her “governmental assignment” and commitment to freedom. (There are so many others who deserve the position of representing freedom in Switzerland and host people like Cory.) While only a minority of the audience in Zurich has fundamentally understood, what Cory is talking about, he was later presenting his concept of post-copyright-war in the talk “the coming war on general computatiion”[11] at the 28th Chaos Communication Congress (28C3)[12], where he found himself in an audience of educated supporters only. (I well remember, when Lawrence gave his talk at the 23C3[13] I was sitting with my GNU costume[14] in one of the first rows ).

Getting back to the subject, let me add that I am writing this e-mail out of a deep concern, which I personally understand as an interconnection of issues which, in the core, are interrelated.
Grown up in Kathmandu, Nepal and living in one of the wealthiest countries, scarce of natural resources but hosting the two largest banks (each of the producing 3 times the GDP) and hosting the head offices of large oil corporations and the weapon industry, I have ever since struggled finding partners to discuss concerns regarding global economy and did only find mental peace in books by Naomi Klein[15] (The Shock Doctrine), André Gorz[16] and Slavoj Žižek.
Even during a project for the European Commission, working as a researcher in Technology Assesment for the project ETICA[17] (Ethical Issues of Emerging ICT Applications), I understood, that within a research project of the EU, the regulations and directives over free/open standards (ODT)[18] are not applied in the research process.

The concept of Freedom of a Free Society seems to remain an Outopos[19] (Utopia), in which freedom fighters are kept busy with their own concerns and discussions.
Over 6 years I have continuously tried to bring and teach the concept of Free Software to an African University[20], giving my partners and fellows all the necessary freedom to continue and bring the project further themselves, while Nicolas Negroponte got corrupted by M$ and the global public nurtured by the disinformative news of a 100$ laptop. – I understood that western NGO’s are driven by exploitation and self-deception, as well as the “recepients” in under-developed countries, who have been tought how to globally represent the neo-imperialist begging culture. The only way for me to continue my commitment to fight at the roots of global exploitation would be in the role of Colonel Kurtz[21].
Last year I tried to enlighten the hacker society at the 27C3[22] with the subject of artistic freedom in Classical Music, which is, as Richard beautifully explains in his statement[23], a very similar concern of musicians and composers, as well as software developpers and authors. – Well, it just has been percieved as “the most beautiful talk ever” (at the Chaos Communication Congress’) and is remembered as a nice music concert, while the fundamental message is being lost.
The last years I have been working with many musicians, film directors and artists who all comprehend and share such views, but when they get an offer by Deutsche Grammophon, Sony Classical Music or whatever big corp. they collapse (e.g. —————-ZENSORED———–) and, in many cases, only perform due to a regular Cocaine consumption ———ZENSORED——, as well as ——–ZENSORED——— at my presentation of “The Concert” at the 27C3).
With ———ZENSORED—–, who is a big shot in Music Management in Europe, managing ———————–ZENSORED——————— etc., I am trying to take the discussion to a level which could bring some significant paradign shift in licenseing music and the rights on music performances. – Total fail! This guy is busy gathering money to feed his family and assure that his kids rise in a decent environment.

So for whose rights are we actually fighting for, if we don’t have the artists, authors and curators on our sides, as they are being kept busy feeding the economy? Economy constantly pulls us back into the mud of self-deception.
For a person who has something to share and something to give, these are tough days…

I think we need a concept to corrupt the system with its own rules. Just like Richard when he copyrighted Freedom by introducing the GPL. A law that excludes the possibility for governments to take away out information, our know-how, our knwoledge.
What if we introduced a “meta-internet”, where everyone that accesses it needs to sign an agreement that as soon as he is entering into this area of unconditional freedom, in which his personality disolves and everyone is part of the whole, he looses the right to claim for any right.

I am tired to continuously fight for things that are so evident and fundamental. I am sad to see that politicians today are not representing respectful positions, but act in interests of corrupt corporations and lobbies.
Is it true that nowadays we need to activate a majority of the global blogosphere, while hundreds of thousands of kids outrage because they can’ t copy-paste their homework because wikipedia is blacked-out, to bring a handful of senators to just postpone a vote on an act that is totally lapse…? – WTF!

The most feasible way out I can see today is to accelerate the self-extermination of humankind, for the sake of a healthy planet.

“Intellectual poperty” … give me a break! – Turn on your brains and start thinking about this faux-pas word for a second.
Everything we were tought, learned and know is fondly based on experience, education and intermediate exchange of information! – We all know, there is no such thing like “divine suggestion”!
So how come, there are still some characters, – especially ego centric artists, film directors and actors, – claiming for copyright? – FUCK IT!

Here’s an exerpt of my latest e-mail:

Dear friends

The last few days, one of the, – to my understanding, – greatest
contemporary film directors is asking me how to block his “copyrighted”,
“intellectual property” in the world wide web, while one of the most
respected and reputable contemporary museum directors, standing for
Ethnology, is asking to provide him hacked serial numbers for
proprietary software.

Let me tell you guys straight: I am a free person, and I will remain
free! – So don’t ever dare to ask me again to support you getting serial
numbers for un-free, proprietary software, nor supporting you to fight
for copyright claims on content that wants to stand free.

The human race has, – unfortunately, – due to selfishness, greediness and capitalism, found ways to nurture a circle of self-deception, instead of leading culture towards freedom.

For the sake of humanity. – Stop bullshitting me in my personal
mailbox!
